COMBINED TABLE TO 1740
I started with a list of all the Toulmins
from PR Bolton-l-S, 1655-1735 (LPRS
42),
and Lancaster 1599-1690 (LPRS 32), noted down by William Toulmin in the
Bodleian
Library when he was an Oxford undergraduate.
I re-arranged these into
date
order, standardized names, and somewhat condensed the entries, and have since
included
entries for other parishes in the area, as indicated below, and a few more
wills. I checked many items in the LPRS volumes, in
particular all those where
there
was a doubt over OS/NS dates.
The surname is omitted: for a summary of the
variants see Appendix I. Names of
marriage
partners are bracketed. In records marked B, "of Bolton" is also
omitted,
but
other places of residence are quoted. I
have presumed a burial was of a child
if the
entry is "... son of" or "... dau. of" etc.
The numbers in the penultimate column
indicate the grouping into 5 families
(probably
all related) shown in Appendix C: some of these are more or less
speculative. (1a, 1b are entered here as 1: they can be
distinguished by the
sources
H and K respectively.) For all items
marked 1, 2, 3 the PR entries (or
other
source) are given more fully under Lond***..., Lond**131..., Lond**...
respectively;
however, it seemed worth presenting the table to show the raw material
that I
derived the grouping from.

KIRKBY LONSDALE REGISTERS
When MEP long ago ran the 1790 baptism of
**6 to earth at Kirkby Lonsdale, she

noted several other Toulmin entries around that date, for which I have
photo-copies
of the BT pages. I eventually got round
to a systematic check of the

PR (in Cumbria RO, Kendal) from 1695 to 1820 (I did not check the BT). All
the
entries appear to relate to members of families 1a, 1b, and 3 of App.C, and are

FREEMEN OF LANCASTER
By the time the first Toulmin appears on the
rolls, this ancient institution was
becoming
anomalous or obsolete. The original
theory was that an apprentice who had
served
his time should go through some procedure involving an oath and a payment to
be
enrolled as "free", and this would give him the right to practice his
trade, the
support
of the "company" (eg Tailors or Weavers) involved, and perhaps other
privileges. How it worked in practice varied much from
town to town. William
Stout's
autobiography gives some illuminating pointers to the practice in Lancaster:
"The common freemen here ... engaged
the aforesaid John Powell to go to London to
apply
to the Earl of [Macclesfield] and his brother, in order to obtain a charter to
incorporat
the common manufactores, butchers, etc., into companys exclusive from the
present
charter of the present governing party.
Which the Earl and his brother,
considering
their former usage here, espoused and solicited. And the mayor and
council
here, with the assistance of our then members of parlament, oposed at great
expense
for some years; but at length they got a charter and put it in execution
here,
whereby they would not permit any to follow a trade of manufactory or butcher
or
gardener in the town or within three miles, exept they obtained the freedom of
some of
their companys. And such as would not
comply were sued in [fictitious]
names
and put to great costs. And the ordnary
tradsmen were grown so insolant and
idle
that, like the dog in the maynger, they would neither worke themselvves nor
suffer
others to work, by which many of them came to poverty and ruin of their
families.
... It cost me some money in the oposition, and [I] left off some smal
branches
of trade [rather] than contend with them.
But in time sevral of them came
to see
it did not affect [effect] what they proposed, or were tired, and others came
to
poverty, that they let it drop so as to have no court or assembly about
it."
(Stout,
p. 101, about 1690-1)
This shows the theory, but also that in
practice Stout was not too much affected
by not
being a Freeman. The same was true on
another occasion: "About this time
this
corporation [Lancaster] had a contest with Liverpoole about the toule of goods
we had
from them, our town aledging that their charter exempted them from passage
toule
all over this nation and Irland. But
for refusing it, our goods were taken
and
kept. But as I was no freeman of
Lancaster, nor could be admited without an
oath, I
released my goods; but my neighbours who were freeman commenced an action
against
the persons who seized their goods, at their own and the Corporation's
charge,
which was defended by the Corporation of Liverpoole, and some hundred pounds
spent
on each side, without being determined." (Stout, p.96, about 1690).
Stout would not swear an oath, being a
Quaker. On this occasion, it sounds as
if
he was
rather the better off for not being a freeman!
Doubtless it varied from
trade
to trade (Stout was a wholesale and retail grocer and ironmonger), and perhaps
there
was a special advantage to weavers in being Freemen: 8 of the 18 Toulmins in
the
roll are so described. The next
quotation suggests that it was important for
Stout's
nephew (apprenticed to a draper) to become a freeman: "It being the custom
of this
borrough [Lancaster] that the present mayor and baylifes have each a power
to give
the freedom each one to whom they please, my nephew William Stout brought in
his
father Leonard Stout a freeman. Which
he took the opertunety of in order to
qualifye
him to bring his sone John in a freeman - who was apprintice at Kendall -
as a
freeman's son for twenty shillings, otherways he could not have got his freedom
to
begin his trade here under the most of twenty pounds." (Stout, p.218, 1734: note
that a
cow cost about £2 and a sheep 3s, according to the valuation of Richard
Toulmin,
d.1681.)
This last quotation is useful as it explains the strong tendency of
Freemen to be
sons of
Freemen. An editorial note (Stout, p.249) confirms this: "The Bailiff of
the
Commons
was with the Mayor responsible for appointing a Committee of four of the
Council
to assess the fine payable by those wishing to become freemen of Lancaster
and not
qualified as sons or apprentices of freemen." Hence many entries in the
roll
(12 out of 18 Toulmins) are of the form "X of ... son of Y"; I
believe this
always
implies that Y was a Freeman, and if the father is not mentioned it is almost
certain
he was not. Thus successive entries can
enable us to construct a family
tree
with considerable confidence.
Freemen were usually of Lancaster or
neighbouring parishes by origin, but sons of
freemen
often enrolled even if the family had moved as far away as Liverpool. The
rolls
down to about 1830 have been printed (Record Soc. vol.90), and I have
consulted
only these. Entries are listed by year, eg 1721-2, which for brevity I
quote
as 1721. The printed rolls include 18
Toulmins, from 1721 to 1830, and give
some
vital information on the family.
Members were usually enrolled in their 20s,
or
occasionally early 30s; one, William Toulmin, appears to have been enrolled at
16,
which was unusual. (I've checked the date 1744-5 for him, and there seems no
doubt
of his identity, and no evidence that he was born long before his baptism.
JMH
points out that he could have been apprenticed as young as 10 and served his
term by
16.)
The following sequence is of particular
interest: all these are marked * in App.C

3. Without it, the identification of Robert the weaver as son of William
would
be uncertain, and William's father Robert had been mistakenly (but almost
inevitably)
identified as Robert (b.1699) son of Richard in family 1 until the 1732
entry
showed me he was the son of Joshua.

Mill, in family 2, George b.1695, who did have a son Thomas b.1730, d.
1753,
who seems too young to fit (but cf. William, also enrolled in 1744, aged 16).

is
certainly identical to a John Toulmin of Lancaster, saddler, who m.
Margaret
Taylor of Bulk in 1729, and whom I have tentatively identified as a
younger
brother (b.1707) of George of the Mill (App.C, family 2). There is a
curious
cluster of three more weavers:

Possibly
another younger brother of George of the Mill, b.1701, about whom we know
little. It would be rather attractive to make these
three Freemen brothers.

All the Toulmins of families 1-3 in App.C
seem to have died or left Bolton by the
time
Abraham was bur. there in 1800. But Thos., John, and Robert Toulmin, weavers,
were
described as "of Bolton-l-S" in 1830 (3e above), so perhaps this
family moved
back
there from Bentham in the 1820s: at the end of section 1b above there are 3
births
that could be attributed to it.
However, I've checked census records for
Bolton-l-S
in 1841 (HO107/528/10 ff.5-23, 11 ff.4-9, 12 ff.5-20, 13 ff.4-10) and
1851
(HO107/2272 ff1-22, 2273 ff.220-241) without finding any Toulmins.

Two marriages (Boyd):

Jeneta, dau. of John Toulmin of Slyne, was
bap. "at Halton" in 1647 (section 1a,

Torrisholme, age
53"
bur 6 Feb 1825 seems to have come from Kirkby Lonsdale (see under 5b and App.C

1b). Thomas b.1814 in App.C family 3
(Lond**13333125), who was one of the
weavers
at Bolton-l-S in 1830, was at Force Bank, Halton in 1836, but at Clawthrop

Burton-in-Kendal in 1838.
Lancaster
There is a batch of entries in the
Lancaster PR from 1605 to 1620 (section 1a
above),
which could all arise from a single family, the children of William who d.
1620
(excluding Margaret, from Bolton, who m. George Rigg in 1611); and we might
speculate
further that William could have been a brother of Robert at the head of
family
1 and Richard at the head of family 3.
Thereafter Toulmins seem to have come
and
gone, but never to have settled for more than a generation until Robert and
Nancy
(see below).
John Toulmin b.1707 at Bolton-l-S (App.C
family 3) settled in Lancaster as a
saddler:
see under Lond**1315.
William 1729-1800 in App.C family 3
(Lond**13333) was "of Lancaster" when Ellin
was
bap. in 1757, but only for a few years.
His great-grandson Robert b.1806
(Lond**13333122)
settled in Lancaster with his second wife Nancy, about 1849, and
descendants
of his are living there still.
John Toulmin (*) was m. at Lancaster in 1776
and his first 5 children baptised
there.

The family of William Toulmin and Elizabeth
Aldren
It is not at present clear where William
came from; the 1851 and 1861 census
returns
are contradictory (see below); the later is not necessarily more reliable,
and
there is no record of his baptism at either Middleton or Bentham. Nevertheless,
I think
it is possible he was a son of William b.1797 in App.C family 3
(Lond**1333317).
Records cited below consistently indicate he was b. in 1820 or late
1819. The history below also indicates a
connection with Bolton-l-S, so it is
possible
he was born there; just possibly he was Lond**13333161. Otherwise, the
first
record of him is at Middleton in the 1841 census (PRO HO107/554/13 f.7), where
he was
aged 20-24 and a Male Servant to a Farmer (Thomas Birkett, 60): there were 3
others
in the household, probably all farm labourers, and 2 Female Servants. I
found
no other Toulmins in Middleton or Overton in that census, and none at all
there
or in Heysham in 1851 (when William was in Lancaster, see below). From his
marriage
in 1848 onwards, quite a detailed history can be reconstructed:

QSP 3733/5-7). In spring 1855, the
couple
had gone [presumably from Lancaster] to reside in Heysham, and at the end of
July
1858 moved to Poulton. They had required no "relief" for upwards of 5
years,
until 3
Nov 1860 when William being sick was temporarily relieved by Poulton; this
continued
until Mar 1861 when his sickness was pronounced permanent [so perhaps
Elizabeth
dealt with the Census return?], and Bolton le Sands [apparently "last
legal
place of Settlement" of both] took over the relief of the family.
(Surprisingly,
William was described as 'tailor' when a daughter m. in 1877 - see
note
[g] after the tree below.)
